The Eastbourne Herald reports that East Sussex resident Malcolm Joel, 75, is contesting a speeding fine, even though he admits to travelling at 33 mph in a 30 mph zone.

The ticket actually claims he was travelling at 36 mph.

He triggered a speed camera on his way into Eastbourne and now refuses to pay the £60 fine. The reason? He contends, "It’s not a speeding trap, it’s a money trap”.

He also says “That’s the entrance for people coming into Eastbourne and if they come in and get flashed they’re not going to come back".

Just how successful Mr Joel's arguments will be remains to be seen.

A spokesperson from the Sussex Safer Roads Partnership commented, “Motorists of course have the right to take the matter to court. If the court finds that an offence has been committed, then the court may decide to increase the level of the fine.”

Any bets on the outcome?

Trust the speedcam partnership to get that scare line in, by the way has anyone ever had a fine increased just because they contested it ???

How about this one? Although I doubt the fine was more than the normal £60 fixed penalty simply because he contested it, rather because the court can impose a higher fine and might tend to do so for time wasting?

1- You could pay it via A4V? However i think your still get the points.

2- Send them in response to there "'Notice of Intended Prosecution'" A Letter of Condictional Acceptance.

3- Send them a letter asking for clarfication of the following:
1a- That you (name) of the (surname) family are a corporation and are subjected to statutory law. (in this case the road traffic act)
1b- Proof that a lawful contract exsits between both parties that you agreed to this.
1c- what the "legal" defonetion of a "person" is.
State they have to present this information in a Affdavit format sworn under oath subject to perjury within 30 days.
After 30 days when you get no response send in (notice of discharge to speeding ticket & fine)

4- Wait till your court date and send in a copy of your birth certicate and ask them to crack on with the hearing. (look at all paperwork it is all adressed to your person ie MR John SMITH not the human being.

5- Just pay it and accept it and the 3 points.

yes they get money out of it stating the obvious but i can just imagine this old bloke moaning prob made his day just to find something to moan about

does he think its ok to speed
