Well after weeks and weeks of waranglings, i have been given Legal Aid and a local solicitor to me has taken on the case, (even though it was refused 2 times in the past)

The prosecution still havent released any more documents as of the pre-tril hearing on the 20th this month, we have now submitted the printout logs from the GPS unit to the prosecution, and a first draft of the technical experts section 9 regarding the video evidence.

I was informed that the prosecutions legal expert has now produced his 50+ page report and i will get a copy tomorrow.

will not be able to let any details out of either reports or printouts until the conclusion of the case, but thought i would let you all know that its still going on.

Hehe! Looks like shaunppl is *busted*. Hope he enjoys his jail time.

Surprised they even considered it as evidence anyway as it's just an editable text file. It shouldn't have even been admissible.

If you actually want to use a GPS to prove your innocence in such cases (assuming you actually are - unlike Shaun), then you need to get a device which digitally signs the recording so that it cannot be altered afterwards. For example the Roadhawk does this (and also records forward-facing video and sound at the same time - digitally signed so it cannot be tampered with). Footage from a Roadhawk has already been used in court, with Roadhawk turning up as the expert witnesses to verify the data.

Me too, but I guess if it was presented as evidence then they have to consider it even if it is weak and it's probably going to be rejected.

Falsifying evidence is a pretty serious thing to do and he's in deep trouble now. Should have just paid the 60 quid. Confused

Unbelievable loss of perspective. A speeding conviction for a driving instructor has some consequences, but a prison sentence is career ending.......

A GPS log will only contain UTC time and that doesn't alter for the stupid daylight saving system we employ in this country, unless the GPS log contained a checksum against each line (as you get with NMEA data) then I don't see this as someone meddling with data unless they actually admitted it.

The two time zones employed in the UK at different times of the year have nothing to do with the UTC time code the GPS clock runs on, why do you have to put an offset in to the clock on a GPS when you get off the plane in the USA - Simples, the UTC time is the same world wide - Mike

shame he seemed to prefer listening to the advice about things being too easy to fake than the advice about WHY you can't use these things in court!!

in theory he didn't lie, in february 2010 he told us he had GPX logs showing he wasn't speeding at that point. that was true. however, he failed to tell us he had driven the route again the previous month in order to make sure he had the correct speed and that he wasn't referring to the actual date/time that he had been caught speeding at!


mike, my take on the UTC/GMT/BST thingy: the logs will have shown UTC time. when he was first caught it will have said, eg, 15:03 so the actual time for him would have been 16:03 (BST = UTC + 1) and that time will have been on the laser reading and the fine etc.

when he ran the route again he maybe made sure that he marked that location as 16:03 so it tied in with his fine. however, when the courts looked at the data they will have looked at the times and added an hour to the UTC log to get 17:03 as the BST equivalent - i.e. he was there an hour later than he said he was.

perhaps it was something like this that tripped him up and he then realised he'd been caught out?

Do you honestly believe a court or the CPS would know the difference between UTC and GMT at any time of the year, ask most lawyers what UTC is and they will reply a "Pop Group" - Mike

No, I honestly don't.


"Do you honestly believe a court or the CPS would know..." the processes involved in a Southern Blot or a Northern Blot and the differnt types of restriction eznzymes required for such processes? No, I very much doubt they would. However, that doesn't mean you cannot use such evidence in court to identify a source of DNA.

Likewise, I would hope that, when faced with this 'amazing, new, unknown UTC' that you speak of that they would find an expert in the field!!
