Rodrigo Diaz was shot dead after a GPS navigation error lead him and friends to the wrong address.

69-year-old Phillip Sailors assumed Diaz was an intruder when he approached his property and after firing a revolver into the air it's alleged that he then shot Diaz as he attempted to flee in the vehicle. Diaz was fatally wounded and died at the scene.

Attorney, Mike Puglise, claims Sailors only fired at Diaz when he accelerated his vehicle towards him but a police report states that the vehicle was leaving at the time the fatal shot was fired.

Sailors has been charged with murder with malice.

Manslaughter (i.e. no pre-meditation)?
