hi all, I've been using my Medion 96800 here in Australia for thre months now and it's been brilliant. All the maps that I have work on it ie GB, USA, europe and Australia. I recently treated myself to a brand new TTGO710 (australia model) and its just as good. However when I tried crossloading all my maps in order that both units will run everything, I came across a couple of problems. the go710 is asking for an activation code each time I try to switch maps. and the new Australia map that came with the go710 will not work on the medion. any ideas anyone on how to remedy this??? |

What you are trying to do is illegal. You did not buy the software you have only bought a licence to use it - just as with nearly all other software such as Windows.
The End User Licence Agreement (EULA) only allows you to use the maps on one unit. If you want to put them on a second one you have to delete them from the first.
Tom Tom protect their software by the use of an activation code. You need to get that from their site using the product code that came with the software. _________________ Peter

The EULA says lots of other things as well, such as, for example, that you cannot lend it to someone. Do you reckon that is "illegal" as well?

Depends on your definition of "illegal".
If you include breaking contract law by reneging on the freely-entered into contract you make when you broke the seal, then - yes. |

Plus, whether the Ts&Cs themselves are legal. IANAL but I strongly suspect that conditions such as not being able to sell the device, or loan it out, wouldnt stand up in a court of law, hence I wonder about the rest of their conditions and thus their legality, including the licensing conditions on devices.
Hence, is it really 'illegal'. Otherwrise, it would actually be illegal to sell your tomtom, somehow I doubt that it is, in the same way that the 'freely entered into' Sony EULA on their infamous copy protected CDs said that if you went abroad you couldnt listen to them! (You really couldnt make this stuff up could you)

Some breaches of the EULA are just that, a civil breach of a contract that can only be remedied by the software provider suing the user. That would probably include the "cannot be given or lent to somebody else" provision.
Whether that particualr provison is even enforceable would depend upon consumer legislation in the country you are in. I have said before that that particular provision is probably voidable in the UK under the Unfair Terms in Consumer Regulations. But that would not necessarily be the case in Australia, where I believe the OP lives.
However some breaches of the EULA may also be "illegal", i.e. a criminal offence. Again that will depend upon the country you are in but legislation in most developed countries, including the UK (and almost certainly Australia) makes it illegal to copy electonic information and use on another machine if the end user agreement does not allow it. Hence my use of the term "illegal" when referring to the specific actions that were being proposed. _________________ Peter
