More than 50 motorists have had their speeding penalty notices cancelled after it was discovered that the camera van that caught them had not had its mandatory annual checks.

the van, one of four in operation with the Cumbria Safety Camera Partnership, clocked 53 motorists in a 30mph limit near to the village of Dalston on 16th February this year.

All the £60 tickets issued to drivers caught by the van were withdrawn when it was discovered that the van should have had an annual checkup to ensure the speed measuring equipment was calibrated and accurate.

Annual check? Thought it had to be once a week or month at least!!??

I can't speak for camera vans but there are two calibrations, a periodic check by the operator one, normally performed weekly, and an annual manufacturer one.

It's the latter that was missed here. If the annual type approval isn't current, then that devices does not have Home Office approval and any evidence obtained is rendered invalid.

I got lucky in Newport and had already received the demand when it was suddenly withdrawn - without any explanation of course!

Looking back I realised the van I got done by didn't have any markings on it and this is now illegal.

It pays to query everything - without incurring any extra costs/points.

(Yes I know I should have had PGPS on GPS on but I was doing a quick local Sunday trip with my wife - I swore she'd have to drive herself in future as this was the second time I'd been done with her in the car. And I subsequently put CamerAlert on my mobile so I would be more likely to have the kit with me even for local runs!)

That's not correct. They have no obligation to put up signs or make their camera vans obvious at all. It must have been withdrawn for another reason.
