Rear-facing Truvelo?

The camera I refer to is now looking more than a little scorched with a burnt tyre at it's base

...but it might well still be working, so I'm not risking points on my licence to find out - he who laughs last and all that

I've now seen the photographic evidence. It was clearly taken from the rear, buy the Truvelo camera. There is no vehicle coming the other way, and my front wheels are clearly on the 3 white lines on the road.

I don't think I've got any choice but to pay the £60 and claim my 3 points. I'll be much more wary of Truvelos in future, whichever way they are facing!

As long as you get a friend or someone that has insurance to drive any car or that car, they can't do anything about it. as you telling them it was you or this other person Driving.

But you named the drive you or your mate, both give a statement that they thats turns in driving and on that day they can't remember who was driving.

Its worked every time for people I know and some get asked to pay the fine but the last 5 or 6 have got away with the fine and the points

When you talking about, this was just last week the last one. the owner can't get done as he is giving the driver but he saying he not 100% sure and his mate saying it was the owner but hes not 100% sure, so they just drop it

I think they call it the "Hamilton Defense" so named after Neil and Christine Hamilton who had a case against them dropped because despite their best efforts, they couldn't figure out which one of them was driving at the time.

Of course, we hear all the time "ahh, that loophole has been closed" but the law hasn't changed. Some cases may be dismissed, others may result in a conviction. If the case ever makes it to court, then it's up to the magistrate to decide if the keeper has made "reasonable efforts" to identify which one of who was driving.

I'm not suggesting that anyone attempt to pervert the course of justice (this will get you in very serious trouble), just that you shouldn't feel bullied into admitting an offense that you may not have committed!

I think that this is sometimes a legitimate claim - I'm having a week's holiday in the UK this summer and my wife, a friend and I will share the driving....how can people be expected to remember exactly who was driving at a given time after they return home if the picture only shows the rear end of your car?

The problem is that when people have been the only person to ever drive a car they've owned, they have tried this excuse and reduced the chances of legitimate driver sharing claims to be viewed seriously.

There was a case with two brothers and they blamed each other and that case got dropped, and that was murder, so why would they not drop a speeding ticket, on the same grounds

Part of the problem is that each police force interprets the guidelines differently there is no consistent nationwide application of the law.

For example, some police forces may allow 10% +2mph whilst others may be more or less tolerant.

A great example I could give is that the brother of a friend of mine was pulled over for 'speeding' despite other motorists driving faster in the same area at the same time and when he pointed this out, the officer said "we're having a game of snooker and we were playing the blue ball - you're driving a blue car so we pulled you over"
