Hi I hope someone can help me with my problem here.

I have a tom tom 910 which I brought last june from halfords, for 499 pounds about a month ago the unit started having problems so I took it back to halfords and they sent it away for repair it came back twice with the unit being repaired but then still having the same problem, (gps not working and unit restting itself) so tom tom said they would send a recon unit to me, now after having this for 2 days this wont work now either, when you start it up it just hangs on the welcome screen, I reset the unit and it still does that. So I rang tom tom suport and they said the unit will have to be sent away for repair. I said no way not going through that again.

So can I ask for my money back as I have had enough of it. if they say they will give me a brand new unit, where do I stand on this as the value of goods they are giving me is only worth 349 as thats the price of the unit now, when I paid for it 499. I just think I want my money back. And another problem is that the mount is loose so when you go over a bump the charging light goes off and comes back on, the guy in the store says this is a normal thing for tom tom and there are no problmes with the 910, my old unit never did this, so I dont agree with him.

Hope someone can help me please with this thanx

Nothing wrong with asking here, a wider audience means more chance of an accurate answer.

Whilst your response gave a useful link, the other was armchair lawyer stuff and rubbish, responsibility always lies with the retailer for warranty matters fulls top Smile

The whole area is a minefield, I'd love to know at what point a consumers right to a replacement changes to a repair though.

For those interested this is what I posted elsewhere :

Quote:
Your argument is totally with Halfords.

Please read ALL of this link, which explains your rights exactly.

I believe Halfords should not have forced you to have the item repaired in the first place, but replaced it. As the Repair has not worked it should now be replaced see Q 11

Please note that you have passed the 6 months time limit for the "reversed burden of proof" so your problem is proving it was "inherently faulty" at the time of purchase see Q 13

You will not be entitled to full refund as you did get some benefit from the item for the months until it failed. see Q 12

Print it and take with you to Halfords... give the manager a copy if needs be, also offer to call both the DTI and you local Trading Standards Office.

Good luck !!

Thank you Darren .. it's nice to know my attempts to help / hold an opinion are so much appreciated ..... perhaps I won't bother in future.... or perhaps you should have read my very first line ??

You misunderstand me, my comment was not aimed at you, it was aimed at the other reply in that thread. As I said, your response was indeed useful and we are in full agreement as to who is responsible Smile

The drawback of the electronic medium I'm afraid, probably more my fault for an ambiguous reply.
