I have just received a Mio A201 from SuperEtrader. Two days after getting it ,the touch screen did not respond for about 10 minuits after powering up.Over the next few days this improved although I noticed that finger pressure on the sides of the unit affected it ,giving false touch signals to various parts of the screen.I wanted to send it back to Superetrader and get a refund and got a returns number from them.The problem is they will only give me a refund if they confirm the fault and the unit now seems to operate ok (at least after a power off period of about 12 hours).I have decided to keep the unit to see if the fault develops again.My questions are:
Has anyone else experienced this fault ?(might it be a design fault)
Is SuperEtrader right to make a refund dependent on them seeing the fault (bearing in mind I made my request within a week of receiving it)?
I have to say that SuperEtrader have given good service in other respects.The unit was delivered on time .They answered the telephone and did reply promptly to my emails. |

Under the sale of goods act(Distance Selling Regulations)
You are entitled to a full refund,replacement , its YOUR choice!
So many people get fobbed off with excuses law is law
If you need anymore advice speak to trading standards

Of course you would be entitled to a refund or a replacement if there was a fault. The point would still be valid about the fault being evident though. If the fault can't be demonstrated I think you would have a problem in court if you pushed things this far. From a retailers point of view you are claiming a fault which doesn't appear to exist.
If the unit is now working then I think you should just use it, with perhaps a formal letter (which you ought to try and get acknowledgement of) that you have registered a fault and are prepared to wait and see if the fault goes away. I understand that you have 10 or 14 days to return goods with no questions asked if you have purchased mail order/online, beyond this I would suggest a definite fault would have to be shown. |

My orriginal point was that I did ask for a refund within 4 days of recieving the unit.Well within the 10-14 days you state (although I thought it was 1 week) so it should have been a no quible refund regardless of whether the fault was seen again. Anyway I have now solved the problem by giving it to a friend! I'm considering getting another with TomTom 5.I and am certainly considering getting a promise in writing from the next retailer I buy from that they will honour the no quible return/refund within the 1-2 week period I assume is specified by the sale of goods act.[/quote] |

I have just looked up the trading standards site myself to check and unfortunately their information sheet says there is no specific time period for a return/refund and the consumer DOES have to demonstrate that a fault exists.Not quite what I was expecting! |

I think you may be looking in the wrong place and at out of date info. The Distance Selling Regulations give you a 14 day (I think that is the period) cooling off period for all sales on the internet (or over the phone). In addition recent regulations (cant remember the name) state that is a product breaks down within 6 months of purchase the onus is on the supplier to prove that it was not faulty when purchased rather than the purchaser to prove that it was. _________________ Peter

Section 10 is the one you want to quote.
