To be fair, reading the article, it looks as though it was true until the new Type Approval was obtained, and I think I recall that being suggested when this was discussed previously.
Yet Another Quote:

This, he says “is a form of rigorous testing that any system must undergo before it can be used for enforcement. Until recently, the only HOTA available applied to cars maintaining their lanes.
