South Dakota Decalares its Red Light Cameras Illegal

pocketgpsworld.comOn March 13, 2006, a Sioux Falls, South Dakota motorist, I.L. Wiedermann, received a claim that he had made a right turn on a red light. After an appeal against his $86 fine failed, he filed a class action suit against the city.

Thenewspaper.com reported yesterday that as a result of this action, a South Dakota circuit court judge has ruled that Redflex Traffic Systems and the city of Sioux Falls' red light camera program has violated procedural due process.

Without the necessary approval from the state legislature the "automated ticketing machines" were deemed illegal. It has still to be decided by a jury whether Redflex is financially liable.
