No, they appointed an expert witness to examine the log file that had been submitted as evidence of innocence.

This is why they call expert witnesses. Wink

Yes, I noticed that too! I checked back through the thread as I could have sworn it was a Garmin nuvi 660. Then I realised that it was a simple typo from Garmin to German Very Happy

Reading this page: http://shallowsky.com/blog/mapping/gpx-timestamps.html

It would appear that the nuvi GPX tracklog adds the timezone to the stamp:

Code:
Track log points, quite reasonably, have time stamps in "Zulu time" (essentially the same as GMT, give or take some fraction of a second). They look like this:

<trkpt lat="35.289519913" lon="-115.227057561">
  <ele>1441.634277</ele>
  <time>2010-10-14T17:51:35Z</time>
</trkpt>

So my guess is that they were using the GPX files rather than the raw NMEA data?

I've not got a nuvi with tracklogging functionality so it's not something I can check. i.e. does it ALWAYS use 'zulu time' or does it change according to your timezone / DST etc?

a bit more: http://www.poi-factory.com/node/29587

Quote:
I have a Garmin Etrex which does Track log. Since the unit doesn't have a localization feature like the nuvi to set your local time zone, it shows the time in UTC format.
I would suggest to compare the GPS time and your clock and check if there is any time difference.

Here is a portion of the track log from my Etrex:

1963.1494141
2009-09-13T16:38:45Z

Notice the Z at the end of the time which indicate Zulu time.

perhaps the nuvi, as it has localisation, will add the appropriate timezone to the timestamp?

No issue if they have, all our advice bears scrutiny. At no point have we given any advice on doctoring data nor would we.

The fact is he has been stupid, and attempting to fool the courts in this way will only ever have one outcome. Simply foolish to even entertain it.

What I find VERY puzzling is that if the offence was committed in winter, and then all our advice through the spring was clearly pointing out how VERY fragile his defence and case would be with GENUINE GPS data, he then goes and falsfies his data anyway in the summer. Grrrr Pistol Shoot Out

WHY then was he even bothering to argue his (false) case here anyway??

Either he is an absolute total idiot, or there are two Shauns. Might be interesting to have a post from shaunppl!! Rolling Eyes

Winter? It was June? Doesn't change the facts though, that his whole story is rather odd in the light of the court result. Unless he hoped this thread would serve as proof of his innocence as well. It could all have been started as an alibi.

I thought he committed the offence in the winter (his first post here was in Feb 2009) and did the rerun later before his court appearance in June, but I may have misread it. I'll look again.

EDIT - Ahh ... Got 2009 mixed up with 2010. Everything seems to tie in ok now.

I suppose in these litigious times I should cover my back (and PGPSW's!) and state what should be obvious.... My suggestion was purely a JOKE, and not to be taken seriously. Rolling Eyes
