Taking TomTom/PC World To Court

Guys,

I've had enough! I've been waiting for almost 6 months for me to be able to use the TomTom 510 and TMC bundle I purchased From PC World back at the end of February this year.

I have had replacements, all failed to work. I have also had promises of a new version that has never materialised. Support tickets are being ignored or replied with comments such as 'you'll have to wait' etc etc.

I have spoken to Trading Standards and the CAB regarding this matter.

I have now written to both PC World and TomTom requesting a full refund due to being sold a product that was 'unfit for purpose'.

Under the 'Sale and Supply of Goods and Services Act 1982' we have the legal right to refuse this faulty and mis-sold product and have a full refund of our money.

As well this Act in 2001 the EU brought in rules that stated that during the first 6 months if anything went wrong, the automatic assumption was that the item was sold with the fault.

I have given both TomTom and PC world 7 days in which to provide a written reply otherwise I will take further legal action and take them to the Local County Court.

I'll keep you all updated (if you are interested) on my progress. I'll also supply the letters I have sent to them both.

Sorry for the slow reply.

PC World provided me with a free replacement TomTom 520 without the TMC.

Based on the fact the TMC is rubbish i thought it was a pretty good deal.
