I have searched but cannot find the answer to this.

I have a TomTom One and this summer, I purchased (legal) Europe maps and loaded them on.

I am now upgrading my TomTom to a higher spec model. Will I be able to load the same maps on to my new model?

Yes, no problem, so long as it is not on two units at the same time (that breaks the EULA).

maybe a silly question, but how do they know how many devices maps are on. is it all based on trust or do they have to give you a new activation code and somehow disable the original codes??

Its a bit complicated and I don't have a complete grip of the details, but basically (I think) you need to get an activation code for any bought maps (by entering the device code of the machine and the product code of the map at the website ttcode.com). This locks the map to that unit. You are allowed to change the code something like twice in two weeks and then not for another six months.
Pre-installed maps are slightly different, but there have been so many conflicting reports about what is or isn't possible, I'm afraid I've lost track a bit.
