A class action lawsuit has been successful in overturning $38.75 million in red light tickets.

Approximately 1.2 million people could be in line for a 50% refund for their fines from the city of Chicago.

The suit claimed the city didn't follow its own regulations - it failed to send a second notice of a violation before guilt was determined and doubled the fine for late payment sooner than they should.

Drivers who received tickets for offences from 2010 to 2015 will share $26.75 million, and $12 million of unpaid tickets will be forgiven.

Reporting on the case, The Chicago Tribune added that an investigation which they began in 2012: "exposed corruption, failed oversight and inconsistent enforcement in the program."

The Tribune identified City Hall bribery for $2 million, malfunctioning cameras, inconsistent enforcement and fines issued even after it was known that yellow light times were dropping below minimum guidelines.

A former City Hall worker was sentenced to 10 years in 2016 for taking $100,000's in bribes to influence tens of millions of dollars in red light camera contracts awarded to Redflex Traffic Systems Inc.

For part of the refunds, Chicago will use ten million dollars it is due to receive from a settlement with Redflex.

A Tribune-sponsored study in 2014 contended that almost 40% of intersections equipped with red light cameras make the roads more dangerous. It found that there was a 22% increase in rear-end shunts and didn't show any safety benefit at intersections that never previously had a problem with right-angle crashes.
